Denise Howell is a seasoned appellate and intellectual property litigator based in Los Angeles. Denise writes one of the first and most popular law-related blogs, Bag and Baggage, coined the term "blawg" and helped pioneer podcasting for lawyers. Microcontent obsessed since 2001, she is frequently quoted in the media on legal issues involving intellectual property and technology law. Dennis Kennedy is a computer lawyer and legal technology expert based in St. Louis, Missouri. An award-winning author, a frequent speaker and a widely-read blogger, he has more than 300 publications on legal, technology and Internet topics, many of which are collected in his e-books. Tom Mighell is Senior Counsel and Litigation Technology Support Coordinator at Cowles & Thompson in Dallas. He has published the Internet Legal Research Weekly newsletter since 2000 and blogged about the Internet and legal technology at Inter Alia since August of 2002. With Tom's singing, Ernie on guitar and Dennis' encylopedic knowledge of rock music, we may have the beginnings of a good band, if this whole blog thing doesn't work out. Marty Schwimmer left a partnership in the largest trademark practice in the world and founded Schwimmer Mitchell, a full-service IP micro-boutique in Westchester County, New York, where he represents owners of famous and not yet famous trademarks. Ernest Svenson practices law with a mid-sized law firm in New Orleans, specializing in business-related lawsuits. Most of his practice takes place in federal court, especially the Eastern District. He is best known for his weblog Ernie the Attorney, which he started as an experiment. Like many experiments it got out of control. Help Wanted: What Qualifications Should A Supreme Court Justice Have?

Now that we are not talking about any one in particular: What experience/qualities would you like to see in a Supreme Court justice? Rank in order of importance. What would you add?

Judicial experience at the appellate level.
Provided legal services to underserved populations.
Bar Association experience.
Law review authorship.
Blogging (heh).
Judicial experience at the trial level.
Teaching.
Fitness (recall Bush's first remark to Roberts).
Judicious.
Membership in an evangelical church.
Private lawyering experience as a litigator.
Ownership of dogs.
Private lawyering experience as an appellate advocate.
Good with numbers.
High number of CLE credits.
Good Martindale Hubbell AV rating.
Owns spiffy 'litigation briefcase'
Will vote the way you want.

Excellence.
Many of the "qualifications" you list are ways that excellence could be revealed, such as appellate judgeship or law review article authorship. Honestly, so are things like Ivy League education. But each of these things is only a way to judge the necessary trait. Lack of the qualification is not a disqualifier.

While I thought that Miers had the excellence to qualify when she was named, it was not demonstrated after the fact. It makes me wonder if her nomination was not intentionally scuttled - by herself or Bush on purpose or by mutineers. For example, her meticulous grammar was well known - and even the source of criticism for being too detail oriented - and yet her response to the Senate was poorly spelled and poorly edited. Very odd.
Looking to the future, I expect that Bush may well nominate an ideologue and get the warfare back the way it had been - between the Reds and the Blues.

Rather an interesting list... as it includes an item I regard as disqualifying. I don't like judges, and particularly high-court judges, with extensive bar association experience. It's been my sad experience that judges who have held high-level state bar (and ABA) office tend to be too deferential to "zealous advocacy" standard, even when they are in a Model Rules state, and just don't pay enough attention to attorney misconduct.

That said, I value, in no particular order:
* Judicial demeanor (whether as a judge or otherwise)
* Clear writing
* Reads Between Lawyers
* Demonstrated high legal ability, especially at the margins of existing doctrine
* Clear writing (can't say it too often)
* Displays signed photo of Ernie or Denise on office wall near other photos of celebrities and politicians
* A distinguished undergraduate background OTHER THAN business, economics, or political science
* Willingness to listen to (and be convinced by) opposing views
* Clear writing
